You guys heard yet? ESTDomains.com has been deaccredited by ICANN. EstDomains have always been involved in allegations of spam and other cyber issues but the official reason for deaccreditation given is the recent conviction of the CEO on cyber crime charges. There about 280,000 domains in the ESTDomains database. ICANN is taking bids for new registrars to take over their slot and manage the domains previously under estdomains.com account. The verdict is in for the online gambling websites and it’s not good. Judge Thomas Windgate has ordered internet gambling websites to prevent Kentucky users from accessing their websites. The Kentucky District Judge has order the companies to execute the order within 30 days or else face a more serious consequence – their domains will be seized by the Kentucky state government. This ruling was a follow-up on the case made by the Kentucky state government against 141 internet gambling websites. In the efforts to curb online gambling, the state government made a legal complaint against these websites and asked that their websites should be shutdown. It caused uproar from the website administrators and owners since their websites are not even hosted in Kentucky. Reactions to the decision of Judge Windgate were mixed. Steve Beshear, the state governor was happy with the ruling. He regarded the ruling as clear indication that illegal online gambling in Kentucky exists and the sheer number of websites available in Kentucky should be a point of concern. He regarded the move as a way of protecting the residents of Kentucky especially the minors who could access these websites without any problem if they are accessible. On the other hand, disappointment is a common reaction among internet investors. The president of ICA or Internet Commerce Association Jeremiah Johnston expressed concern regarding the decision. This decision has placed every website in the world vulnerable to any local ruling. With thousands of unique laws in every country, almost every website could be charged in doing something illegal. It could be that only Kentucky will be doing this practice for now but there is a great chance that it will be adopted in other states and even in other countries as well. As part of their reaction to the ruling, call to Boycott products that were manufactured and/or controlled in Kentucky is sought after by the OCA or Online Casino Advisory. They called to boycott Pizza Hut, Taco Bell, KFC and Lexmark – companies that have headquarters in Kentucky. The boycott could send a signal of disappointment to the governor and which could help change the decision.
Just got a mail from EuroDNS about this- A scam involving .fr domains.
AFNIC is advising registrants of .fr domain names of a scam asking them to register for a service with the “Registre Internet Français” directory by a German company called DAD Deutscher Adressdienst GmbH. The service offered costs between €800 and €1,000. There have been many enquiries to AFNIC as to the legitimacy of the offer, leading to AFNIC to clarify that it has no link whatsoever with DAD Deutscher Adressdienst GmbH. Their address is Postfach 760230, 22052 Hamburg, Germany. AFNIC also advises it offers no such service.

A court in the Southern District of Florida recently barred a trademark owner, who sought possession of a domain that allegedly infringed on his mark, from asserting claims under then Lanham Act and the Anti-Cybersquating Consumer Protection Act (ACPA) due to the Doctrine of Laches, thus dismissing the case in favor of the defendant.
The doctrine of laches is considered in the legal realm to be an “equitable defense” that rewards those who diligently assert their claim and penalizes those who procrastinate when avowing their rights. Under this doctrine if party delays in stating their claim and as a result that delay unfairly prejudices the opposing party then the opposing party may assert the defense of laches. Generally, for a party to be unfairly prejudiced it must be shown that as a result of the delay the opposing party is in a worse position now then at the time the claim should have been brought.
In the case at hand the defendant acquired assets including the domain diamondbrite.com and trademark rights in the mark “Diamond Brite” as it apples to electronic signs. In 2002 the plaintiff, owner of the “Diamond Brite” trademark with respect to cleaning products, sent an email to the defendant seeking to procure the domain. No action was taken upon this request. In 2005, the plaintiff sent a cease and desist letter to the defendant and demanded immediate possession of the domain. The defendant refused the transfer but asked for more information regarding the plaintiffs’ trademark. The defendant did not hear from the plaintiff again until 2007 when they received a second cease and desist letter to transfer the domain which the defendant again refused. After the second refusal the plaintiff sued the defendant for trademark infringement under the Lanham Act and the ACPA.
In response to the lawsuit the defendant filed a motion to dismiss the case based on the defense of laches. The court asserted the defendant needed to prove three elements to be successful on a laches defense. These elements are (1) a delay in asserting a right or claim; (2) that the delay was not excusable; and (3) that there was undue prejudice to the party against whom the claim was asserted. In applying the elements to the case at hand the court determined that the plaintiff’s actions, which consisted of merely sending an email and letters over the course of five years, constituted a delay. Second, the court believed that there was no excuse for the delay. And third, the court determined that the said delay would unfairly prejudice the defendant as it would require them to amass eight years worth of evidence which the court found to be burdensome. Based on this analysis the court granted the defendant’s motion and dismissed the case under the doctrine of laches.
